As the third member of the legal team, you'll serve as the primary legal advisor to HR leadership on employment law matters while managing a diverse litigation portfolio. Further, this role offers a unique opportunity to start with a primary focus on litigation and employment while gaining exposure to and experience in commercial and transactional matters to broaden your skillset as an in-house generalist. This position reports to the General Counsel and is remote.Responsibilities:Employment Law Counseling &amp; HR Partnership<ul><li>Provide day-to-day advice to HR and management on employment matters including hiring, discipline, terminations, leaves of absence, accommodations, and workplace investigations</li><li>Advise on wage and hour compliance, worker classification, and payroll practices across multiple jurisdictions</li><li>Draft and review employment policies, handbooks, agreements, and other HR documentation to ensure legal compliance</li><li>Advise on labor relations and collective bargaining agreement compliance</li><li>Partner with HR and Operations teams to minimize litigation risk and ensure compliance with federal, state, and local employment laws</li></ul>Litigation Management<ul><li>Manage litigation matters across all practice areas from inception through resolution, including employment disputes, auto accident claims, workers’ comp claims, commercial litigation, and consumer claims</li><li>Draft and review pleadings, motions, discovery responses, and other litigation documents</li><li>Handle discovery management, settlement negotiations, and trial preparation across diverse legal matters</li><li>Represent the company in administrative proceedings and mediations</li><li>Develop litigation strategy and oversee outside counsel relationships to ensure cost-effective case management</li><li>Coordinate with insurance carriers and manage coverage issues for various types of claims</li><li>Provide litigation risk assessments and strategic recommendations to leadership</li></ul>Commercial &amp; Transactional Law Development<ul><li>Gradually take on contract review, revision, and negotiation responsibilities across various business functions</li><li>Collaborate with cross-functional teams on legal aspects of new business initiatives and product launches</li></ul>Skills &amp; Qualifications:<ul><li>4-8 years of employment law and litigation experience </li><li>In-house legal experience at a high-growth technology or e-commerce company with significant HR advisory responsibilities (law firm and government candidates with experience working directly with HR teams are also encouraged to apply)</li><li>Attorney in good standing in their state of bar admission </li><li>Strong interest and aptitude for learning commercial/transactional law with eagerness to expand skill set</li><li>Deep knowledge of federal and state employment laws, including Title VII, ADA, FMLA, FLSA, and state-specific regulations</li><li>Experience with workplace investigations, EEOC proceedings, and state agency matters</li><li>Comprehensive litigation experience including case strategy, discovery management, motion practice, and settlement negotiations</li><li>Able to understand business needs and partner with your colleagues across the company to find creative solutions, with a strong understanding of the interplay between legal and business risk</li></ul>Details of Position &amp; Benefits:<ul><li>Salary range: $175,000 - $195,000 / year </li><li>Comprehensive medical, dental, and vision insurance</li><li>401(k) </li><li>Annual Misfits grocery box credit of $1200 paid in weekly installments</li><li>Life insurance</li><li>Paid vacation time</li><li>Paid holidays </li><li>Paid sick days</li></ul>Please see here for Misfits Market's <a href="https://www.misfitsmarket.com/careers-privacy">Job Applicant Privacy Notice</a>.
